JAFTA Terms of Service

Welcome to JAFTA. By creating a JAFTA account or using any JAFTA websites or services, you agree to these Terms of Service (the “Terms”). These Terms govern your access to and use of our platforms located at https://jaftaonline.vip and https://jaftaonline.org (collectively, the “Sites”), and any tools, features, content, or services we make available (the “Services”).
Please read these Terms carefully. By accessing or using the Sites or Services, you accept and agree to be bound by these Terms, including any terms expressly referenced in these Terms (for example, our Privacy Policy, Acceptable Use rules, and any country‑specific notices).
1. Account Terms
1.1 Eligibility.
To register for a JAFTA account (“Account”) you must be at least the age of majority in your jurisdiction, or have reached eighteen (18) years, whichever is greater, and you must be registering for business, professional, or organizational purposes.
1.2 Accurate Information.
You agree to provide true, current, and complete information during sign‑up and to keep it updated, including your legal name, organization name (if applicable), address, phone number, and a valid email address that we can use to contact you (“Primary Email Address”).
1.3 Security.
You are responsible for keeping your password and Account credentials secure. JAFTA is not liable for any loss or damage arising from your failure to maintain Account security. We may require additional security measures from time to time.
1.4 Acceptable Use.
You agree not to misuse the Services, bypass technical limitations, or use automated tools to access or monitor the Sites or Services. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without JAFTA’s prior written permission.
2. Account Activation
2.1 Account Owner.
The individual or entity that registers the Account is the contracting party (“Account Owner”) and is responsible for all activity under the Account.
2.2 Team Access (if enabled).
Where made available, the Account Owner may invite additional users with defined permissions (“Team Members”). The Account Owner is responsible for the actions of all Team Members.
2.3 Payment Profiles.
If you enable paid membership features or other paid offerings, you are responsible for activating and maintaining any required payment profiles or gateways with third‑party processors and for complying with their terms. Card network logos (e.g., Visa and other international card marks) may be displayed for convenience.
3. JAFTA Rights
3.1 Service Changes.
We may add, change, or remove features and may suspend or discontinue any part of the Services at any time.
3.2 Refusal or Termination.
We reserve the right to refuse access to the Services or to suspend or terminate Accounts for any reason, including suspected fraud, violation of these Terms, or legal compliance requirements.
3.3 Monitoring.
We may review activity on the Services for compliance purposes but are not obligated to do so.
4. Your Responsibilities
4.1 Compliance with Law.
You are responsible for ensuring that your use of the Services complies with all applicable laws and third‑party rights.
4.2 Content and Materials.
You are responsible for any information, media, or other materials you upload or provide via the Services (“Materials”). You must ensure you have all rights necessary to provide your Materials and that they are lawful and accurate.
4.3 Member Interactions.
Any interactions between you and other members are solely between you and those members. JAFTA is not a party to, and has no responsibility for, disputes between members.
5. Payment of Fees and Taxes
5.1 Membership Fees.
Where applicable, membership or subscription fees are billed in advance and are non‑refundable except as required by law or as expressly stated by JAFTA.
5.2 Taxes.
You are responsible for all taxes, duties, and charges that apply to your membership or purchases, other than taxes on JAFTA’s income.
5.3 Refunds.
Refund requests, where permitted, will be reviewed on a case‑by‑case basis in accordance with the Refund Policy applicable at the time of the request.
6. Confidentiality
Each party agrees to use the other party’s non‑public information only as necessary to perform obligations under these Terms and to protect such information using safeguards at least as strong as those used to protect its own confidential information. Confidentiality obligations do not apply to information that is public, independently developed without use of the other party’s confidential information, or obtained lawfully from a third party.
7. Limitation of Liability and Indemnification
7.1 No Indirect Damages.
To the maximum extent permitted by law, JAFTA and its affiliates, officers, directors, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses.
7.2 Liability Cap.
JAFTA’s total liability for any claim arising out of or relating to the Services is limited to the amounts you paid to JAFTA for the Services in the twelve (12) months preceding the event giving rise to the claim.
7.3 Indemnity.
You agree to defend, indemnify, and hold harmless JAFTA and its affiliates, officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your breach of these Terms or referenced policies; (b) your Materials; or (c) your violation of law or third‑party rights.
8. Intellectual Property and Your Materials
8.1 Ownership.
The Sites and Services, including all content, design, software, and trademarks, are owned by or licensed to JAFTA and are protected by applicable intellectual property laws.
8.2 License to JAFTA.
By submitting Materials through the Services, you grant JAFTA a non‑exclusive, worldwide, royalty‑free license to host, display, and use your Materials as necessary to operate and improve the Services. You represent that you have the rights necessary to grant this license and that your Materials do not infringe third‑party rights.
9. Additional Services and Third‑Party Services
9.1 Optional Features.
From time to time, JAFTA may offer optional features or beta services. Such features may be modified or discontinued at any time and are provided on an “as is” basis.
9.2 Third‑Party Services.
The Services may integrate with or link to third‑party products or services (for example, payment processors or identity verification providers). Your use of any third‑party service is governed by that third party’s terms and privacy policies, and JAFTA is not responsible for such services.
9.3 Physical Deliveries (future).
JAFTA does not currently deliver physical products. In the future, JAFTA may offer physical items such as membership ID cards or merchandise. These items may be collected in person or shipped for an additional fee, or accessed digitally via your profile. Specific delivery terms will be provided if such offerings are introduced.
10. Feedback and Reviews
If you send ideas, suggestions, or other feedback, you grant JAFTA a perpetual, irrevocable, worldwide, royalty‑free license to use that feedback without restriction or obligation to you.
11. Intellectual Property Infringement
JAFTA respects intellectual property rights. If you believe content on the Sites infringes your rights, please notify us with sufficient detail to identify the material and the right asserted. JAFTA may remove or disable access to allegedly infringing content and may terminate repeat infringers’ Accounts where appropriate.
12. Privacy and Data Protection
Your use of the Services is subject to JAFTA’s Privacy Policy, which explains how we collect, use, and safeguard personal information. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.
13. JAFTA Contracting Party
Your agreement is with JAFTA. These Terms and any disputes arising out of them are governed by the laws of Jamaica, without regard to conflict‑of‑laws rules. Unless otherwise required by law, you agree to submit to the exclusive jurisdiction of the courts located in Jamaica to resolve any dispute arising from these Terms or the Services.
14. Term and Termination
14.1 Term.
These Terms begin when you create an Account or first use the Services and continue until terminated.
14.2 Your Termination.
You may terminate at any time by deactivating your Account and ceasing all use of the Services.
14.3 Our Termination.
We may suspend or terminate your access for any reason, including non‑payment, legal compliance, or breach of these Terms. Upon termination, you remain responsible for fees incurred up to the termination date. Certain sections, by their nature, will survive termination (including Sections 5, 6, 7, 8, 12, 13, 15, and 16).
15. Modifications
We may update these Terms from time to time. If a change materially adversely affects your rights or use of the Services, we will provide reasonable advance notice when practicable. Changes take effect when posted to the Sites. If you do not agree to the amended Terms, you must stop using the Services.
16. General Conditions
16.1 Entire Agreement.
These Terms (including policies referenced in them) constitute the entire agreement between you and JAFTA regarding the Services and supersede any prior agreements.
16.2 No Waiver.
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
16.3 Severability.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
16.4 Assignment.
You may not assign or transfer your rights or obligations under these Terms without JAFTA’s prior written consent. We may assign these Terms without notice as part of a merger, acquisition, or other corporate transaction.
16.5 Language.
These Terms may be provided in multiple languages. In the event of a conflict, the English version controls.
